Supreme Court to Decide Whether Appeal Permitted if IPR Time Bar Does Not Apply

The Supreme Court heard oral argument on whether 35 U.S.C. § 314(d) permits appeal of the PTAB’s decision to institute an IPR upon finding that 35 U.S.C. § 315(b)’s time bar does not apply. The Court’s decision will issue in due course. Thryv, Inc. v. Click-To-Call Technologies, LP, No. 18-916.
